The mother of a son who lost his life in a fatal motorcycle accident is now taking legal action against the driver of the second vehicle. The mother claims that the driver, a woman, was negligent as she operated her vehicle. The Texas wrongful death lawsuit seeks an undisclosed amount of damages.
On March 29, the son was apparently driving his motorcycle in Beaumont when he approached an intersection. As he pulled up to the intersection, a second driver pulled up at approximately the same time. However, the driver of the second vehicle did not brake at the stop sign, and she collided with the motorcycle. The motorcyclist was fatally injured in the accident.
The mother claims that the driver of the second vehicle failed to operate her vehicle safely as well as exercise ordinary care. Among several other accusations, she also accuses the driver of failure to apply her brakes properly, failure to yield the right-of-way and failure to steer to avoid a collision. The mother asserts that the driver's negligence led to her son's death, which could have otherwise been avoided.
The mother seeks several items of damages in her Texas wrongful death suit. Some damages she seeks on behalf of her deceased son, such as the mental anguish and pain and suffering that he experienced prior to death. She also claims damages for her own mental anguish as well as compensation for funeral expenses and court costs. Any individual who has experienced the death of a loved one due to the negligent actions of another party may choose to pursue legal action similar to this case.
